Introduction

HR has been among the most dynamic areas of American law for decades. And as 2023 got underway, it promised to be the most dynamic year EVER! The November national elections illustrated like no prior elections did just how evenly divided America is. Nowhere is the political tug-of-war more intense than in the labor and employment arena. From the National Labor Relations Board to the EEOC to the Department of Labor, pro-employee, pro-union initiatives are either underway or in the offing. The states are equally active, from wage and hour initiatives to the ongoing upheavals in marijuana legislation, abortion rights v. restrictions, and class actions v. mandatory arbitration. Organized labor hasn’t been this aggressive in a generation. No employer, regardless of size, economic sector, or geographic location can risk hiding its head in the sand.
